Rewarding Bad Aim

Could someone please explain to me why the penalties for murder and attempted murder are different?  They both involve the same criminal intention to kill someone, right?  So why do we increase the punishment for those competent enough to do it right?

It’s the same thing with drunk driving.  Those that were lucky enough not to hit someone get off with a fine, some courses, and higher insurance premiums.  But the unlucky ones go to prison.

Isn’t it wrong to base our punishment on the outcomes rather than the actions?

(Possible answer: if we imprisoned all the drunk drivers, there would be no one left to run the government?)
